The rules of the road.

These are the terms governing your use of Marmello. They're written in plain English. If anything is unclear, email hello@marmello.media and we'll explain.

Who we are

Marmello is operated by Dizzy Otter Ltd, a company registered in England ("we", "us"). The platform is at marmello.media.

What you're signing up for

Marmello is a managed marketing service combined with a software platform. Depending on your plan tier we may produce content, run ads, capture leads, and provide a portal where you can review the work and what's coming next. Plan details and pricing are at marmello.media#plans.

Your account

• You're responsible for keeping your sign-in details safe.
• One workspace covers one business. If you run multiple businesses you need a separate workspace per business.
• You must be authorised to act for the business whose data you're uploading. Don't connect a Facebook Page you don't admin.

Payment

Plans bill monthly in advance. You can cancel at any time and access continues to the end of the current billing period. We don't refund part-months. Late payment may suspend the service until brought current.

What we'll do

• Deliver the work described in your plan tier. Where the plan includes a creative element (content, ads, edits), we'll use reasonable effort and best judgement.
• Keep your data confidential — see our privacy policy.
• Tell you about material changes to the service or pricing at least 14 days in advance.

What we won't do

• Guarantee specific business outcomes (leads, sales, follower counts).
• Share your data across clients or sell it.
• Publish content on your behalf that we believe is misleading, unlawful, or breaches a platform's policies. We'll flag and discuss before refusing.

Acceptable use

You agree not to:

• Use Marmello to break the law or any platform's terms.
• Upload content you don't have the rights to (photos, footage, audio, etc.).
• Attempt to access another tenant's data.
• Resell or sublicense the platform without written agreement.

Content ownership

You own the content you upload and the content we produce on your behalf. We grant ourselves the limited right to host, transform, and deliver that content via the platform — including handing it to Meta, Google, and other ad platforms — strictly to provide the service.

Third-party integrations

The platform connects to Meta (Facebook Pages, Lead Ads), Google, Anthropic (for AI drafting), Resend (for email delivery), and Supabase (for data storage). These third parties have their own terms; by connecting them via Marmello you accept those terms.

Cancellation and data export

You can cancel at any time by emailing hello@marmello.media. On cancellation we'll provide a one-off export of your data on request, then delete the account per our data deletion policy.

Liability

We'll do our best, but the service is provided "as is". To the extent allowed by law, we're not liable for indirect or consequential loss (e.g. lost profit, lost goodwill). Where we're liable, our total liability in any 12-month period is capped at the fees you paid in that period.

Governing law

These terms are governed by the laws of England and Wales. Disputes go to the courts of England and Wales.

Changes

If we change these terms materially we'll email everyone with an active account at least 14 days before the change takes effect. Continuing to use Marmello after the change means you accept it.
